At Five Star Luxury Travel, we take the satisfaction of our guests very seriously. To ensure that all of our reservations are in compliance with local laws and our own terms and conditions, we reserve the right to cancel any reservation that violates them.
In addition, we understand that plans can change and unforeseen circumstances can occur. To accommodate for this, we also reserve the right to cancel a reservation for any reason within the first 48 hours of booking. In the event of a cancellation, we will provide a full refund to the guest.
We apologize for any inconvenience this may cause, and we assure you that we will make every effort to find you an alternative accommodation that meets your needs and exceeds your expectations. If you have any questions or concerns about our cancellation policy, please do not hesitate to contact us. We are always happy to assist you and make sure your vacation planning is as stress-free as possible.
To protect against cancellations we recommend that guests purchase trip cancellation insurance to assure refund of deposits paid and reimbursement of other vacation payments. Such insurance is available through travel agents, auto clubs such as AAA, or online at companies like www.generalitravelinsurance.com, www.bhtp.com. **Five Star Luxury Travel does not recommend, refer or endorse any of these companies.
Terms and Conditions
By Agreeing to the “Terms & Conditions” you bind this reservation to the following terms. Full rental amount specified on the booking must be paid up front. The full rental amount is the total rental amount including all taxes & applicable fees. All payments and reservations are non-refundable.
**Guests staying in condo-hotels receive access to all amenities that are open**
When/if a maintenance issue arises guest shall notify Five Star Luxury Travel. The main phone number for FSLT is 1-305-330-6182. Please do not contact the resident front desk or onsite management at your property with maintenance issues, please contact us and we will respond right away.
Check-In Process
Please notify Five Star Luxury Travel at least one day prior to your check-in date with your arrival time. A Five Star Luxury Travel representative will be meeting you at the residential front desk and checking you into your property. If you are staying in a condo, it is required by the buildings.
Check-in time is after 4 p.m.
Check-out time is at or before 11:00 a.m.
If you are staying at a condo-hotel, at check-in, you will be presented with a Tenant Registration Form by the resident front desk staff. You will have to acknowledge and provide a credit card to open a House Account which will allow you to charge incidentals and miscellaneous things to your condo throughout the time of your stay.
Additional Charges (NOT included in rate)
Rates do NOT include daily maid service (unless noted), gratuities, car rental, food, liquor, outside laundry service, personal items, valet parking, excessive cleaning upon departure (i.e. upholstery or rug shampooing, etc.). Valet parking is not included in your daily rate. In some properties valet charges are waived for all reservations 30 nights or more in length, please inquire with us about valet fees at your property once you finalize your reservation with us.
If you are staying in a condo-hotel, at Check-in, the resort will charge you a Daily Resort Fee if you're stay is less than 30 nights in length. This is charged per condo not per guest. This fee is waived for all reservations 30 nights or more in length. Valet parking charges and resort fee charges vary from property to property, please inquire with us about these fees once you finalize your reservation with us.
Housekeeping prices for daily maid service are as follows for condo-hotels:
1 Bedroom - $120
2 bedroom - $150
3 bedroom - $175
4 Bedroom = $200
Housekeeping prices for single family homes and non condo-hotel properties will be quoted after reservations are finalized.
Maid service is performed between 10 a.m. - 5 p.m. EST unless otherwise scheduled. The cleanings last approximately 2-3 hours. This is a great time to go to the beach or do some shopping. The cleaning service has a key to your property so you do not have to be there during the service(s). We ask that you please always lock your valuables in the safe provided when leaving your property on the day of your cleaning service. It is mandatory that we use our own cleaning staff due to insurance purposes. We cannot allow tenants to hire their own cleaning staff or bring their own cleaning staff.
Each bathroom contains toiletries. These are not to be taken from residence. There will be a fee of $35 per missing bottle. If you would like to purchase a new bottle of our signature toiletry fragrance, we will be glad to sell this to you. Please inquire about pricing.
Check-out is at 11a.m. Guests will be charged the equivalent of one nights rent if they remain in their properties past check-out time. We do not have grace periods for checkouts unless otherwise authorized through expressed written permission from Five Star Luxury Travel.
Reservations and Payments
Upon booking your reservation and payment being made, a confirmation email will be issued to you.
Condition of Rental
The property shall be in the same condition upon departure as at check-in. Normal wear and tear excepted. Five Star Luxury Travel or its agents may enter the property at reasonable times to make repairs or provide maid service. You may cook in areas specifically designated for cooking. Please immediately notify Five Star Luxury Travel or someone from the 1 Hotel Resident Front Desk Staff of fire or other damage to the property if/when this occurs. The direct phone number for the 1 Hotel Resident Front Desk is 1-305-604-6572. Guest shall be liable for all acts of their family, invitees, employees, or other persons invited onto the property. Guest may not sublet or assign this rental agreement. Guest shall be responsible to return all keys upon departure to the Resident Front Desk. Guest shall abide by the House Rules of Five Star Luxury Travel and/or Properties as provided in our Rental Agreements and our Terms and Conditions. Guests shall not bring any pets onto the property without prior approval by Five Star Luxury Travel. Guest will not smoke indoors to include electronic cigarettes. Guest will rinse feet of sand prior to entering the unit. No bleaching or dying of hair inside properties as stains are very hard to remove from surfaces. No parties shall be allowed without prior consent. Additional charges may apply. No catering or outside music permitted without prior consent, additional charges may apply. Guest and other invitees shall use hotel amenities such as the pool, gym spa , beach area at their own risk. Guest understands that there are certain inherent risks to person and property located adjacent to the ocean, including the possibility of drowning. Guest acknowledges that the owner would not rent the property unless the guest accepted this condition.Real estate showings of the property must be allowed with a 24 hour notice\
Security Deposit Protection
You will be required to provide a major credit card (Visa, Master Card) number to be used as a security deposit in case of any property damage found during property inspection. The deposit will be held in Five Star Luxury Travel's Client Trust Account and will be returned, minus deductions, not later than 7 calendar days after the termination of the agreement. We must give you a written statement at that time explaining any deductions. Deductions can be made for the following reasons: to repair or replace anything that is damaged or missing; additional cleaning expense or to clean excessive dirt (i.e. stained carpets, furniture, walls, appliances, etc.) and put the unit, and the things in it, in the condition provided upon check-in. If your deposit is not enough to cover all the damages and costs, you must pay the extra amount, and you authorize us to charge the credit card provided.
Our properties are inspected before and after each reservation. If, during your stay at one of our Rental Properties, a guest, family, or invitees of guest causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the guest will reimburse Five Star Luxury Travel for the cost of repair or replacement of such property.
Pet Policy
Our properties are 100% pet free unless otherwise authorized in writing by Five Star Luxury Travel. Guests wishing to bring a pet of any size or kind into our propertiesmust receive written authorization from Five Star Luxury Travel prior to + of stay. Additionally, hotel requires a pet form to be filled out at the resident front desk registering all animals prior to check-in with the hotel. If you bring a pet without the prior written authorization of Five Star Luxury Travel you will be automatically charged between $500 and $1500 plus any damage done by pet.
Limitation of Liability
Under no circumstances shall Five Star Luxury Travel be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by Five Star Luxury Travel or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; Five Star Luxury Travel, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Five Star Luxury Travel will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Under no circumstance are tenants allowed to open communication panels. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, biking, and running. This list is not all-inclusive, but indicates some of the hazards of vacationing in Miami Beach. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, unfenced pools, clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this property, you acknowledge that in all events and circumstances, Five Star Luxury Travel, its officers and employees shall not be liable. Five Star Luxury Travel reserves the right to cancel or rescind any rental agreement if it is found that the guests are conducting unlawful activities, not abiding by the Home Owners Association House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of this Rental Agreement.
Holdover, Abandoned Possessions
You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.
Notice of Absence and Service of Notice
If you stay in the unit, without written permission, after the Rental Agreement has ended, you will be a holdover tenant and may be liable for three times rent under the Rental Agreement on a prorated daily basis for each day you are a holdover tenant. If you leave any personal property, which we determine to be of value, we must contact you by phone, email and/or mail a notice. After 20 days, if you do not respond, we may advertise the items for sale or donate them to a charitable organization. If we have to give any notice to you, we can serve it to any occupant. By serving one of you, we have given notice to all of you. If we cannot deliver a notice to you, we may post the notice in a conspicuous place in or on the unit.
Insurance
You understand that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the Rental Agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage including damage from fire, water, theft, or any cause.
Changes To a Booking
An additional $100.00 administrative fee will be charged by Five Star Luxury Travel for any change to a booking after a confirmation has been issued. Acceptance of any change is subject to approval by Five Star Luxury Travel.
Cancelation and Refunds
All reservations are non-refundable. Cancelation of bookings at any-time after confirmation has been issued will result in forfeiture of deposit(s). To protect against cancellations we recommend that guests purchase Trip cancelation insurance. Such insurance is available through travel agents, auto clubs such as AAA, or online at companies like www.generalitravelinsurance.com, www.bhtp.com. **Five Star Luxury Travel does not recommend, refer or endorse any of these companies**
Acknowledgement
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named on the guest list. The credit card supplied at the time of reservation will be held for backup security purposes only. By checking off the terms and conditions you accept the above terms. We accept: Visa, Master Card If you are paying with a credit card, please fill out the form below. If the credit card you are using is under a name other than the one listed with us for your reservation, the cardholder will need to sign this Rental Agreement as well.
Credit Card Safety
We at Five Star Luxury Travel, and its affiliate websites are committed to keeping your personal information safe. Our secure server software (SSL) is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read as the information travels over the Internet.
THE COMPLETE CREDIT CARD INFORMATION MUST BE FILLED OUT ON THIS RENTAL AGREEMENT BY THE GUEST TO VALIDATE THE RESERVATION. EACH SPOT REQUIRING THE RENTERS' INITIALS AND/OR SIGNATURE ON THIS DOCUMENT MUST ALSO BE COMPLETED IN ORDER TO VALIDATE THIS RESERVATION.
If you have a reservation longer than 6 months in length, you can pay 50% up front and the balance will be due 60 days prior to check-in. Reservations under 6 months in length are required to pay the entire reservation up front at the time of booking. If you fail to pay the entire amount of your reservation within 24 hours of signing your rental agreement you forfeit your reservation. It will be considered automatically cancelled at that time.
Emergency Contact
If the name on the credit card is different from the name of the registered guest staying with us, we will need the signature of the cardholder letting us know they authorize the use of their credit card for the payment of this reservation. We will need the first and last name of the cardholder and their signature. We look forward to your visit! Upon completion of this rental agreement you accept our terms.
